1. About this privacy policy

Moira Solutions Limited (“Moira”, “we”, “us” or “our”) respects your privacy and is committed to handling personal data lawfully, fairly, securely and transparently. This policy explains how we process personal data when you visit the Moira website, submit an enquiry, request a DataLink demonstration, propose a partnership, contact us by email, telephone or WhatsApp, or communicate with us about careers and business opportunities.

This policy is intended to align with the Personal Data Protection Act, 2022 (Cap. 44) of Tanzania and applicable regulations. It applies to this website and the related communications described below. Separate contractual privacy and data-processing terms may apply where Moira provides software, DataLink or professional services to an organisation.

2. Who is responsible for your personal data

Moira Solutions Limited is certified by Tanzania’s Personal Data Protection Commission (PDPC) as both a data controller and a data processor. This reflects the different responsibilities Moira may hold depending on the activity and the relationship involved.

• As a data controller, Moira determines why and how personal data is processed for activities such as website enquiries, partnership discussions, recruitment communications, client relationship management and the administration of our own business operations.
• As a data processor, Moira may process personal data on behalf of a client organisation when delivering software, DataLink, systems integration, support or related professional services. In those circumstances, Moira processes personal data under the client’s documented instructions and the applicable service and data-processing terms.

Where a client organisation is the data controller, its privacy notice will explain how it uses personal data and should be read together with any relevant service-specific information.

3. Personal data we collect

The information we collect depends on how you interact with us.

Information you provide directly

• Contact details: your name, business email address, telephone number and preferred contact method.
• Professional information: job title, employer, company or institution, country, market and region.
• Enquiry information: project requirements, business challenges, demo requests, product interests, proposed partnership type and other details included in your message.
• Recruitment information: information you send when expressing interest in working with Moira, such as your experience, skills, portfolio, CV or professional profile.
• Correspondence: emails, telephone or WhatsApp messages, meeting notes and records of our response.

Information collected when you use the website

Our website, hosting providers and Google Analytics may process limited technical and usage information such as IP-derived approximate location, browser and device type, requested page, referring page, session activity, date and time, and security or error logs. We use this information to understand website performance and improve content and navigation. We do not use the website to serve personalised advertising.

Information from other sources

We may receive professional contact information from your organisation, a mutual business contact, an event, a public professional profile, a technology partner or another source where it is lawful and reasonable to use that information for a relevant business purpose.

4. How we use personal data

We may use personal data to:

• respond to general enquiries and arrange calls or meetings;
• understand a project, prepare a proposal and manage a potential or existing client relationship;
• provide DataLink information, demonstrations, implementation discussions and product support;
• assess and develop sales, technology, implementation or market-entry partnerships;
• evaluate employment enquiries and communicate about suitable opportunities;
• operate, maintain, troubleshoot and secure our website, systems and communications;
• maintain appropriate business, contractual, financial, compliance and audit records;
• protect Moira, our clients, partners, users and systems from fraud, misuse or security threats;
• establish, exercise or defend legal claims and comply with lawful requests or legal obligations; and
• send relevant business communications where you have requested them or where otherwise permitted by law.

We do not sell or rent personal data. We do not use website enquiry information for unrelated advertising.

5. Grounds for processing

Depending on the circumstances, we process personal data with your consent, to take steps at your request before entering into an agreement, to perform an agreement, to comply with a legal obligation, to protect vital or legal interests, or for a legitimate and proportionate business purpose that does not unfairly override your rights. Where processing relies on consent, you may withdraw that consent at any time, without affecting processing already carried out lawfully.

6. Website forms and FormSubmit

Our contact, project, partnership and DataLink forms use FormSubmit to transmit completed form information to [email protected]. FormSubmit acts as an external form-delivery provider and processes the information needed to transmit and protect the submission. FormSubmit states that form submissions may be retained in its submission archive for up to 30 days. Do not include passwords, payment-card details, medical records, national identification documents or other highly sensitive information in a website form unless Moira has specifically requested it through an approved secure channel.

7. Third-party services and external links

• Google Analytics: the website uses Google Analytics 4 to measure visits, page use, interactions and website performance. Google may process device, browser, network, approximate-location and online-identifier information according to its own terms and privacy documentation.
• Google Maps: the Contact page contains an external map link. Google receives information according to its own terms and privacy policy when you follow that link.
• WhatsApp: the Contact page contains a link that opens a WhatsApp conversation with Moira. Meta and WhatsApp process information according to their own terms and privacy policies when you use that service.
• FormSubmit: website-form data is transmitted through FormSubmit as described above.

External services control their own websites and platforms. We encourage you to read their privacy notices before providing information to them.

8. When we share personal data

We may share personal data only where reasonably necessary with:

• authorised Moira personnel who need it for their work;
• hosting, email, communications, form-delivery, security and other technology service providers acting for us;
• professional advisers such as lawyers, auditors, insurers and accountants;
• technology or delivery partners where this is necessary to respond to your enquiry or develop an agreed opportunity, subject to appropriate confidentiality controls;
• regulators, courts, law-enforcement bodies or other authorities where disclosure is required or permitted by law; and
• a successor or transaction participant if Moira undergoes a legitimate reorganisation, investment, merger or transfer of business, with suitable safeguards.

We require service providers and recipients to handle personal data only for authorised purposes and with appropriate protection.

9. International transfers

Some website and communications providers may process or store information outside Tanzania. Where personal data is transferred across borders, we take reasonable steps to ensure the transfer has a lawful basis and appropriate technical, organisational or contractual safeguards, taking account of the sensitivity of the information and the protections available in the destination.

10. Data retention

We retain personal data only for as long as reasonably necessary for the purpose for which it was collected, including follow-up, contract management, security, dispute resolution and legal, regulatory, tax or accounting requirements. Retention periods vary according to the nature of the relationship and information.

• General enquiries that do not develop into an active relationship are periodically reviewed and deleted or anonymised when no longer needed.
• Client, supplier and partnership records may be kept throughout the relationship and for an appropriate period afterwards to meet contractual and legal requirements.
• Recruitment information is retained only while it remains relevant to current or reasonably anticipated opportunities, unless a longer period is required or agreed.
• Technical and security logs are retained for the period reasonably necessary to operate, diagnose and protect the website.
• FormSubmit states that submissions in its archive are retained for up to 30 days; delivered copies may remain in Moira’s controlled business email records according to the applicable purpose.

We may retain limited information for longer where necessary to demonstrate compliance, prevent repeated unwanted contact, resolve a dispute or establish, exercise or defend legal claims.

11. Security

We use reasonable administrative, technical and physical measures designed to protect personal data against accidental loss, unauthorised access, alteration, disclosure or destruction. Measures may include access controls, confidentiality obligations, secure configuration, backups, monitoring and supplier assessment. No internet transmission or storage system can be guaranteed completely secure, so please use an appropriate secure channel when sharing confidential or sensitive information.

If we identify a personal-data breach, we will assess it, contain it and make notifications to affected individuals or the relevant authority where required by applicable law.

12. Your data-protection rights

Subject to applicable law and any permitted limitations, you may have the right to:

• be informed about the collection and use of your personal data;
• request access to personal data we hold about you;
• request correction of inaccurate or incomplete personal data;
• request erasure or destruction where the data is no longer lawfully required;
• request restriction of processing in appropriate circumstances;
• object to certain processing;
• request data portability where applicable;
• withdraw consent where processing is based on consent;
• raise concerns about automated decision-making; and
• complain about our handling of your personal data and seek any remedy available under law.

Moira does not currently use information submitted through this website to make decisions based solely on automated processing that produce legal or similarly significant effects.

13. How to exercise your rights

Send your request to [email protected] with the subject “Privacy request”. Describe your request and the relevant interaction with Moira. We may ask for information needed to confirm your identity and protect your data from unauthorised disclosure. We will respond within the period required by applicable law.

If you are not satisfied with our response, you may raise a complaint with Tanzania’s Personal Data Protection Commission through its official website at pdpc.go.tz.

14. Children’s privacy

This website is intended for organisations, professionals and adult users. We do not knowingly seek personal data from children through our enquiry forms. If you believe a child has provided personal data without appropriate authorisation, contact us so we can assess and delete it where required.

15. Cookies and similar technologies

The Moira website uses Google Analytics cookies and similar technologies to distinguish visits, understand how pages are used and measure website performance. These may include cookies such as _ga and a property-specific _ga_* cookie. Google Analytics is configured for measurement rather than personalised advertising. Essential technical information may also be processed by the website host to deliver and secure the site.

You can control or delete cookies through your browser settings. Blocking analytics cookies may reduce the information available to us but should not prevent access to the main website content. Google also provides information about its analytics privacy practices and browser opt-out options through its own websites.

16. Changes to this policy

We may update this policy when our website, services, suppliers or legal obligations change. The latest version will be published on this page with a revised effective date. Material changes may also be communicated through an appropriate additional notice.
